Acceptable Use Policy

This AUP applies to all use of the Orbilex platform, including the operator dashboard, client portal, provisioning pipeline, API, and any services provisioned through the platform. It applies whether you are:

• An Operator using the platform to manage your hosting business;
• A member of an Operator's team (admin, billing, or support staff);
• An end-client accessing a white-label portal powered by Orbilex.

Operators are responsible for ensuring their end-clients comply with this AUP. An Operator's failure to enforce this AUP against their end-clients may result in action against the Operator's account.

The following types of content are strictly prohibited on the platform and on any infrastructure provisioned through it:

• Child sexual abuse material (CSAM). Any content that sexually exploits or depicts minors. This is a zero-tolerance violation and will result in immediate termination and referral to relevant law enforcement authorities without prior notice.
• Malware and harmful code. Distribution, hosting, or facilitation of viruses, ransomware, spyware, trojans, keyloggers, rootkits, or any other software designed to damage, disrupt, or gain unauthorised access to systems.
• Phishing and fraud. Pages, emails, or assets designed to deceive users into disclosing credentials, financial details, or other sensitive information. This includes fake login pages, fraudulent invoices, and identity theft schemes.
• Illegal content. Content that is unlawful in the jurisdiction where it is hosted or accessed, including but not limited to: illegal gambling operations, unlicensed firearms sales, controlled substance sales without appropriate authorisation, and content that infringes copyright or trade mark rights.
• Terrorist and extremist content. Content that promotes, glorifies, facilitates, or recruits for acts of terrorism or mass violence, or that is produced by designated terrorist organisations.
• Hate speech and harassment. Content that promotes hatred, violence, or discrimination against individuals or groups based on protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability, etc.), or that is intended to harass, threaten, or stalk individuals.

The following activities are prohibited regardless of the content involved:

• Unsolicited bulk email (spam). Sending unsolicited commercial or bulk emails to recipients who have not provided explicit consent. This includes any email that violates the CAN-SPAM Act, CASL, or equivalent legislation.
• Network attacks. Conducting or facilitating distributed denial-of-service (DDoS) attacks, port scans, packet sniffing, man-in-the-middle attacks, or any other action intended to disrupt or gain unauthorised access to networks or systems.
• Unauthorised cryptomining. Using the platform's compute resources, or any infrastructure provisioned through it, to mine cryptocurrency without the explicit written consent of Palladium Innovations. Cryptomining consumes disproportionate resources and degrades service for other operators.
• Platform abuse. Attempting to reverse-engineer, decompile, or disassemble proprietary components of Orbilex; circumventing or disabling security features, rate limits, or access controls; scraping the platform in a manner that creates excessive load; or accessing other operators' data without authorisation.
• Unauthorised resale. Reselling or sublicensing access to the Orbilex platform to third parties without an explicit written reseller agreement with Palladium Innovations.
• Privacy violations. Collecting, storing, or processing personal data in violation of applicable data protection law, or disclosing personal data about individuals without a lawful basis (doxxing, unauthorised surveillance, etc.).
• Impersonation. Impersonating Palladium Innovations, Orbilex, or any other entity in a manner that is deceptive or misleading.

Operators must not use the platform in a way that places unreasonable or disproportionate load on shared infrastructure. Palladium Innovations reserves the right to rate-limit, throttle, or suspend access to accounts that exceed reasonable usage thresholds.

Reasonable usage thresholds are defined in the plan documentation for each subscription tier. For cloud-hosted plans, resource quotas (API requests, storage, email sends) are enforced automatically. Operators who need higher limits may contact legal@orbilex.app to discuss an enterprise arrangement.

If you believe content or activity on a platform powered by Orbilex violates this AUP, please report it to legal@orbilex.app with the subject line “AUP Report”. Include:

• A description of the content or activity and why you believe it violates this AUP;
• The URL or other identifier of the content or account involved;
• Any supporting evidence (screenshots, logs, correspondence).

We acknowledge all reports within 2 business days and will keep you informed of the outcome to the extent permitted by law.

Palladium Innovations respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and equivalent international law.

How to submit a takedown notice. To report allegedly infringing content, send a written notice to legal@orbilex.app with the subject line “DMCA Takedown Notice” containing all of the following:

• Your physical or electronic signature (or that of a person authorised to act on the copyright owner's behalf);
• Identification of the copyrighted work(s) claimed to have been infringed;
• Identification of the infringing material and information sufficient to locate it (URL, screenshot, or other identifier);
• Your contact information (name, address, phone number, and email address);
• A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or applicable law;
• A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on the owner's behalf.

Counter-notification. If your content was removed in response to a takedown notice and you believe the removal was in error, you may submit a counter-notification to legal@orbilex.app with the subject line “DMCA Counter-Notification” containing: your physical or electronic signature; identification of the removed material; a statement under penalty of perjury that the material was removed by mistake or misidentification; your name, address, and phone number; and consent to the jurisdiction of the federal court in your district. We will forward valid counter-notifications to the original complainant.

Repeat infringers. Palladium Innovations will terminate accounts of operators who are found to be repeat copyright infringers.

Palladium Innovations uses a graduated enforcement approach based on the nature and severity of the violation:

• Warning. For first-time, non-severe violations, we will issue a written warning with a deadline to remediate the violation. No service interruption.
• Temporary suspension. For repeated violations or moderate-severity violations, we may suspend access to the affected service or the entire account pending resolution. We will notify the Operator by email.
• Immediate termination. For severe violations — including but not limited to CSAM, active malware distribution, DDoS attacks, or fraud — we will terminate the account immediately and without prior notice. No refund will be issued.
• Law enforcement referral. Where we believe a violation constitutes a criminal offence, we will cooperate fully with relevant law enforcement authorities and may provide account data as required by applicable law or court order.

Palladium Innovations' decision to enforce this AUP does not create any obligation to monitor all content hosted through the platform, and enforcement actions taken in good faith do not create liability to the Operator or any third party.

If your account or service has been suspended or terminated and you believe the action was taken in error, you may submit an appeal. The appeals process is as follows:

• Step 1 — Submit your appeal. Email legal@orbilex.app within 14 days of the enforcement action with the subject line “AUP Appeal”. Your appeal must include: your account email, a description of the action taken, why you believe the action was in error, and any supporting evidence.
• Step 2 — Review. A member of our team who was not involved in the original enforcement decision will review your appeal within 5 business days.
• Step 3 — Outcome. We will notify you of the outcome by email. If the appeal is upheld, the enforcement action will be reversed and service restored within 1 business day. If the appeal is denied, we will provide the reasons for our decision.

Appeals are not available for zero-tolerance violations (CSAM, active DDoS attacks). Our decision on appeal is final.

Palladium Innovations may update this AUP from time to time to address new threats, legal requirements, or changes to our services. We will notify operators by email and via in-platform notice at least 14 days before material changes take effect. Continued use of the platform after that date constitutes acceptance of the updated AUP.

We may make immediate changes without prior notice where required to respond to an active security threat or to comply with an urgent legal obligation.
